Terms of Service – Bayside Brownie Company

1. Introduction

Welcome to Bayside Brownie Company (“we,” “us,” “our”). By placing an order with us, visiting our website, or engaging with our products and services, you agree to be bound by these Terms of Service. Please read them carefully before ordering.


2. Governing Law

These Terms of Service are governed by the laws of Queensland, Australia. You and Bayside Brownie Company submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.


3. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law (ACL).
Our goods come with guarantees that cannot be excluded under the ACL. Should a product be received by you that is not in a satisfactory position, then no refund (part / full) will be given unless the product is returned and assessed.  


4. Orders & Payments

  • All prices are listed in Australian Dollars (AUD) and include GST where applicable.

  • Full payment is required at the time of placing your order.

  • We reserve the right to refuse an order if payment is not received in full or if stock is unavailable.


5. Shipping & Local Delivery

  • We currently offer free local pickup and local delivery to selected postcodes only, as outlined on our Shipping Policy page.

  • Risk in the goods passes to you upon delivery to your nominated address or collection from our premises.

  • We offer Australia wide delivery of our BrownieGrams and BrowniePics, and some of our slabs.  Photos of the product are taken before they leave our premises.  Should you not be happy with them on arrival, within 24 hours, please take photos, and contact us via email (including photos) to discuss a resolution.


6. Returns & Refunds

  • Due to the perishable nature of our products, we do not accept returns for change of mind.

  • If your order is incorrect, damaged, please contact us within 24 hours of delivery with photographic evidence so we can arrange a suitable resolution in line with the ACL.


7. Allergens & Dietary Information

  • All products are made with gluten-free ingredients; however, gluten-containing products are handled in the same kitchen, and cross-contamination may occur despite a separate preparation area being used.

  • It is your responsibility to advise us of any allergies or dietary requirements when placing your order.


8. Media Release – Permission to Use Cake Photos

By placing your order, you grant Bayside Brownie Company permission to take and share photographs of the product you ordered on our website and social media platforms for marketing purposes.
This includes cakes, brownies, and any personalised items such as BrowniePics featuring images you have provided. If you prefer not to have your order photographed or shared, please let us know in writing at the time of your order.


9. Intellectual Property

All content on our website, including text, images, logos, and designs, is our property or used under licence and may not be copied, reproduced, or distributed without prior written consent.


10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of our website or products, except as required by the ACL.


11. Changes to These Terms

We may update these Terms of Service from time to time. Changes will take effect immediately upon posting on our website. Your continued use of our services constitutes acceptance of the updated Terms.
